Terms of Service

1. Acceptance of Terms
By creating an account, accessing the dashboard, or otherwise using Mara ("the Service"), operated by Junghard Software AB, you agree to these Terms of Service and our Privacy Policy. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the Service.
2. Service Description
Mara is an AI lifecycle marketer that designs, drafts, schedules, sends, and continuously improves lifecycle email programs (welcome, activation, churn-save, win-back, re-engagement, expansion, feature-adoption, dunning) for the company that hires her. The Service is accessed via the web dashboard and chat interface at hiremara.com.
Outbound email is delivered through Molted, a separate email-platform operated by the same legal entity. Sending behaviour is also subject to Molted's Terms of Service.
Features, integrations, and supported providers may change over time. We will give reasonable notice before removing functionality that materially affects your use of the Service.
3. Account Registration and Security
To use the Service you must create an account with a valid email address. We use passwordless magic-link authentication; we never store passwords. When you sign up we automatically provision a tenant, default brand profile, and onboarding wizard state for your account.
- You must provide accurate, current account information.
- You are responsible for safeguarding access to the email inbox you use to receive magic links. Anyone with that inbox can sign in to your tenant.
- You are responsible for all activity under your account, including every email Mara drafts and every send she dispatches under your approval policy.
- You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
4. Acceptable Use
Mara exists to help indie SaaS companies run lifecycle email programs to their own customers. You agree not to use the Service to:
- Send spam. No unsolicited bulk email. No purchased, rented, scraped, or harvested recipient lists. Every recipient must have a legitimate basis for receiving your email under applicable law (existing customer relationship, opt-in consent, or equivalent).
- Connect data you have no right to. The GitHub repositories you connect must be yours or your organization's. The contact lists and event streams you provide must contain only people whose data you have a lawful basis to process.
- Abuse sending infrastructure. Do not attempt to bypass, circumvent, or disable approval gates, kill switches, suppression lists, rate limits, or fatigue controls.
- Send harmful content.No phishing, social engineering, malware distribution, fraud, or content designed to deceive recipients about the sender's identity or intent.
- Impersonate.Do not misrepresent your identity or your company's identity in headers, From addresses, or message content. Mara writes in your voice; you remain the actual sender.
- Send illegal content. No content that violates applicable law, including CAN-SPAM, GDPR, CASL, and other anti-spam and data-protection regulations.
- Attack the Service.Do not probe, scan, or test vulnerabilities; do not overload infrastructure; reverse-engineer internal systems; or interfere with other customers' use of the Service.
- Resell without authorization. Do not resell or redistribute the Service as your own product without a written agreement from us.
Violations may result in immediate suspension or termination of your account without prior notice. We report illegal activity to relevant authorities.
5. AI Agent Responsibility
Mara is an autonomous AI agent that drafts and sends email on your behalf. This creates specific responsibilities:
- You are responsible for what she sends. Every email Mara dispatches under your account is your responsibility, whether you approved it manually or set her approval policy to auto-send. The agent acts on your behalf as her hirer.
- The approval gate is a guardrail, not a guarantee. The per-tenant approval policy (auto-send, approval-required, draft-only) helps you control what leaves the outbox, but it does not replace your obligation to review the content Mara generates for compliance with applicable law and these terms.
- Monitor her drafts. Mara keeps a reasoning trace and audit log for every specialist call. You are expected to read the weekly digest and review the audit log when something looks off. Sustained inattention is not a defense.
- Brand profile accuracy is yours. Mara extracts your voice, value proposition, and product surface from your homepage, repo, and prior emails. If the extraction is wrong, you are expected to correct it in the brand-profile editor. We are not liable for sends produced from an inaccurate brand profile you had the ability to fix.
6. Billing, Subscriptions, and Overages
Plans
The Service is offered in two plans: Starter ($99/month) and Growth ($299/month), with custom plans available by arrangement for higher volumes. All plans require a valid payment method on file and begin with a fourteen day trial; cancel before the trial ends and you pay nothing. Pricing is per active journey; full details on the pricing page.
Billing cycle
Starter and Growth are billed monthly in advance, or annually with two months free. Custom plans are billed as agreed in writing. All fees are non-refundable except where required by law. You may cancel at any time; access continues through the end of the current billing period.
Volume and active-journey limits
Each plan specifies a maximum number of active journeys and monthly sends. Contact records are unlimited. Sends in excess of your plan's monthly limit are charged at an overage rate disclosed on your plan details. Activating an additional journey above your plan's limit prompts an upgrade.
Failed payments
If payment fails, we will retry and notify you. After a reasonable grace period (typically 7 days), we may suspend sending until payment is resolved.
Price changes
We may adjust pricing with at least 30 days' written notice. Price changes take effect at the start of your next billing cycle after the notice period. If you disagree with a price change, cancel before it takes effect.
7. Usage Limits and Sending Policies
All email sent through Mara is subject to automated policy enforcement at two layers. Mara's own layer enforces per-tenant approval policy, send-window quiet hours, per-contact fatigue limits, and weekly per-recipient caps. Molted's layer (the sending pipe) enforces deliverability suppression, consent records, IP warm-up state, and complaint thresholds.
When a send is blocked by either layer, the outbox row is marked with the reason and surfaced in the dashboard. Blocked sends do not count against your tier's monthly volume.
8. Interfaces and API Access
Mara is accessed through the web dashboard and a streaming chat interface today. A public tenant-facing REST API is on the roadmap but not yet generally available. Internal API endpoints used by the dashboard are not stable interfaces and may change without notice. Do not script against them.
9. Data Ownership and Processing
Your data is yours. You retain full ownership of the content Mara drafts for you (after approval or edit), the contact records you provide, the events you stream to us, the brand profile we extract for your tenant, and the configuration you set (journeys, segments, approval policy, send windows).
For data about your end customers (the recipients of Mara's emails), you are the data controller and we are the data processor acting on your documented instructions. A data processing agreement is available; see the trust page or contact [email protected].
You grant us a limited, non-exclusive license to process your data solely to provide and improve the Service: drafting emails, computing segments, running the bandit across journey-step variants, generating reasoning traces, and enforcing approval policy. We do not sell your data. We do not use your data to train models.
Upon account termination, you may request export of your data within 30 days. After this period, we delete your data from active systems in accordance with our Privacy Policy. Backups may retain data for up to 90 days after deletion from active systems.
10. Intellectual Property
The Service, including its software, agents, prompts, designs, documentation, and branding, is owned by Junghard Software AB and protected by intellectual property laws. These terms do not grant you rights to our trademarks, logos, or brand assets, including the name "Mara" and the moth mark.
We do not claim ownership of the content you ship as your own (the emails you approve, the brand profile you correct, the segments you tune). Each party retains their respective intellectual property rights.
11. Service Availability
We target high availability but do not guarantee uninterrupted or error-free service. Mara's availability depends in part on third-party providers (Anthropic for model inference, Molted for sending, your event source). Specifically:
- Scheduled maintenance windows will be announced at least 24 hours in advance when possible.
- We are not liable for delivery failures caused by third-party providers, recipient mail servers, DNS misconfigurations on your sending domain, or other factors outside our control.
- For Starter and Growth, we make commercially reasonable efforts to maintain service availability but do not offer a guaranteed SLA or service credits.
- Custom plans may include an availability SLA and service credits negotiated in writing.
12. Termination and Suspension
By you
You may close your account at any time from the settings page. Closing your account cancels your subscription at the end of the current billing period. No prorated refunds are issued for the remaining days in the period.
By us
We may suspend your account immediately and without notice if we reasonably believe you have violated the Acceptable Use or AI Agent Responsibility sections of these terms. For other violations, we will give you reasonable notice (typically 7 days) and an opportunity to cure before suspension.
We may terminate your account for: repeated violations after warnings, non-payment after the grace period, legal requirements, or if we discontinue the Service entirely (with at least 90 days' notice in that case).
Effect of termination
Upon termination, Mara stops drafting and sending for your tenant, scheduled jobs pause, and dashboard access is disabled. You have 30 days to request a data export. After 30 days, we delete your data per our retention policy. Sections that should survive termination (liability, IP, governing law) survive.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- Cap.Junghard Software AB's total aggregate liability for any and all claims arising from your use of the Service is limited to the amounts you paid us in the 12 months immediately preceding the event giving rise to the claim, or $100, whichever is greater.
- Exclusions. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or reputational harm, regardless of the theory of liability.
- No guarantee of delivery.Email delivery depends on factors beyond our control (recipient servers, spam filters, DNS configuration). We do not guarantee that any specific email will be delivered to a recipient's inbox.
- No guarantee of model output. Large language models can produce inaccurate, biased, or surprising output. The approval gate exists for this reason. We are not liable for the content of a draft you chose to ship.
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Indemnification
You agree to indemnify and hold harmless Junghard Software AB, its officers, employees, and agents from any claims, losses, or damages (including reasonable legal fees) arising from: (a) your use of the Service, (b) email sent through your account, including drafts you approved or auto-send sends produced under a policy you set, (c) your violation of these terms, or (d) your violation of any applicable law or regulation.
15. Changes to Terms
We may update these terms from time to time. When we make material changes, we will notify you via email to your account address and post a notice on the Service at least 14 days before the changes take effect. Non-material changes (typo fixes, formatting) may be made without notice.
Your continued use of the Service after the effective date of updated terms constitutes acceptance. If you disagree with the changes, stop using the Service and close your account before the effective date.
16. Governing Law and Disputes
These terms are governed by the laws of Sweden. Any disputes arising from these terms or your use of the Service will be resolved by Göteborgs tingsrätt (Gothenburg District Court), Sweden.
Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.
17. General Provisions
- Entire agreement. These terms, together with our Privacy Policy and any written agreement we sign with you, constitute the entire agreement between you and Junghard Software AB.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
